Law on retailing oils

Hello,

Does anyone know the law on retailing diluted essential oils NOT as aromatherapy or medicinally?
Does there have to be certain clauses I need to include to protect myself or do I have to be a fully trained aromatherapist to sell them at all??!!??

I believe you can sell ready made potions if you are not trained as an aromatherapist, but you cannot sell blends without a certificate. If you do have a certificate in aromatherapy you can sell blends you make but you would need to inform your insurer that you intend to do this to be covered, may cost a little extra on your premium.

If you buy ready mixed there's no problem at all. Just be careful and let people know you're selling the goods and the responsibility is with them to determine if they are allergic and such.

Hi Gussie, I may be wrong and somebody (probably Essence will correct me here) but I was under the impression that you are responsible for anything that you sell-on, including pre-blended products. The responsibility lies with you I think, not the client.

The consumer protection act 1987 provides the customer with protection when purchasing goods or services to ensure that products are safe for use on the client during the treatment or are safe to be sold as a retail product.

The sales and supply of goods act 1994 makes the seller responsible for ensuring that the goods are of suitable merchantable quality. The person giving the service must do so with reasonable care and skill.

Product liability insurance protects the therapist against claims arising from products used by clients.

If you then decide to sell blends that you have made yourself you can do this regardless if you are an aromatherapist or not but legally this becomes a totally different ball game - you need to include all the ingredients and label very carefully. The ATC have an information pack on this that you can purchase to help you through all the legal requirments. Also aromantic can help you with this www.aromantic.co.uk as they have a company that will insure you if you use their products whether you are a therapist or not.

It is quite a minefield out there so be careful, the days of making creams and selling them at a country fair are becoming rare.

I'd best dig my things out, I know there are disclaimers I was advised to use, which basically said that you as a vendor take every care to ensure the products are safe but the clients should refrain from using them and check that no reaction will occur before using them in earnest.. basically that you do what you can bu are not responsible personally for misuse or if there's a reaction IF they haven't abided by the guidelines.. never got around to marketing blends, so can't really comment further, was based on what I could recall at the time.
