A San Jose man has been convicted of committing sexual battery against a client at a Campbell spa, the Santa Clara County Office of the District Attorney announced Tuesday.
Massage therapist Richard Wayne Slate was found guilty late last month in a jury trial for a misdemeanor charge on three alleged batteries at two separate spas in San Jose and Campbell.
Slate was charged with sexual battery against three women. Two of the women were clients of his previous employer, Burke Williams in San Jose. According to the district attorney’s office, Slate was found guilty on charges brought by one of Slate’s Campbell clients who visited Elements Massage.
According to the district attorney’s office, a 32-year-old woman visited Elements Massage in March 2016 and reported being sexually touched without consent numerous times during the massage. Initially the woman did not say anything due to shock.
After the massage the woman confronted Slate and he apologized. The woman told the receptionist what happened, and the police were called to arrest slate.
The district attorney’s office said Slate has lost his massage license after the Campbell incident. According to the district attorney’s office, the prosecution is asking Santa Clara County Superior Court Judge Elizabeth C. Peterson for the maximum sentence, which would be a year in jail. Slate will also have to register as a sex offender.
